The proposed addition and the use of the expanded structure per <br /> Municipal Zoning Code Section 10.28, Subdivision 3 (A), referring <br /> specifically to schools, will have no negative impact on the surrounding <br /> residential zone and developed properties. <br /> c. The proposed addition will not create the need to redirect drainage. <br /> Drainage will continue to sheet flow over paved areas to southern lot line <br /> and eventually to drainageway within municipal owned property. <br /> 4. The Council finds that granting a conditional use permit to allow construction of <br /> an addition to the day care/school structure will not be detrimental to the health, <br /> safety or general welfare of the public, would not adversely affect light, air nor <br /> pose a fire hazard or other danger to neighboring properties, nor will its use <br /> depreciate surrounding property values: and that the use of the property for <br /> school-related uses will be in keeping with the intent and objectives of the Zoning <br /> Code and Comprehensive Plan of the City. <br /> 5. The City Council has considered this application including the findings and <br /> recommendations of the Planning Commission, reports by City staff, comments <br /> by the applicant and the effect of the proposed variance on the health, safety and <br /> welfare of the community. <br /> CONCLUSIONS, ORDER AND CONDITIONS <br /> Based upon one or more of the above findings, the Orono City Council hereby <br /> grants a conditional use permit per Municipal Zoning Code Section 10.28, Subdivision 3 (A) to <br /> permit construction of a 36' x 50' addition to the existing school/day care structure per plans <br /> submitted by EOS Architecture dated January 22, 1993, Sheets 1 - 3 (P) and as amended below <br /> for the property located at 770 Old Crystal Bay Road North, subject to the following conditions: <br /> 1. Applicant shall provide an executed Developer's Agreement to ensure all required <br /> improvements have been installed per final submitted for this review. <br /> • <br /> Page 2 of 5 <br /> Form 5005 Disk Orono <br />
