ditV 0 4i. <br /> O O CITY of ORONO <br /> A �`�� a„ RESOLUTION OF THE CITY COUNCIL <br /> ti 6312 <br /> lkESHOg� <br /> its proximity to Old Crystal Bay Road North, the proposed parking area is set back 6 feet <br /> from the existing building where a 10 foot setback from the building is required; <br /> WHEREAS, development of the Property is subject to the provisions of <br /> the Crystal Bay Business Center Development Agreement dated December 5, 2007 and <br /> its subsequent Amendments; <br /> WHEREAS, the Owner has requested the City extinguish the provision <br /> requiring removal of the existing building on the Property listed within the Crystal Bay <br /> Business Center Development Agreement; <br /> WHEREAS, after due published and posted notice, a public hearing was <br /> held by the Orono Planning Commission on January 22, 2013 regarding said industrial <br /> site plan, CUP and variance requests and all interested persons were given an <br /> opportunity to be heard; and <br /> WHEREAS, at meetings held on March 25, 2013 and August 26, 2013 <br /> the Orono City Council voted to approve the site plan, the CUP and the variances based <br /> on the following findings: <br /> 1. There is adequate space for landscaping and vegetative screening between Old <br /> Crystal Bay Road and the parking areas and building to mitigate any negative <br /> views. <br /> 2. There is adequate space with which to provide foundation plantings between the <br /> parking area and the building. <br /> 3. The Owner also owns the adjacent property to the north at 550 Old Crystal Bay <br /> Road North, a portion of which is currently vacant open space and available for <br /> future parking development. <br /> 4. The Owner provided documentation as to the maximum number of parking stalls <br /> necessary per each shift at 550 Old Crystal Bay Road North and 450 Old Crystal <br /> Bay Road North. <br /> 5. Based on the allocation of uses within the building, per City Code Section 78- <br /> 827, 101 parking stalls are required for the Property. <br /> 6. 39 parking stalls will be provided at the Property (450 Old Crystal Bay Road <br /> North); 62 parking stalls will deferred to the southern portion of 550 Old Crystal <br /> Bay Road North. <br /> 7. According to the Owner, the parking needs at 450 Old Crystal Bay Road North <br /> are as follows: <br /> a. Weekday Shift—24 stalls <br /> b. Weeknight Shift—7 stalls <br /> c.
