(b) Exceptions from rental licensing . <br />(1) Rental property which is licensed as a nursing home or boarding care home by <br />the State of Minnesota Department of Health shall be exempt from the license <br />required under this article. This exception shall not apply if no services are provided <br />to the tenants, or the services are incidental to, or independent of, the <br />landlord/tenant relationship. <br />(2) State licensed residential facilities. <br />(3) A single-family dwelling or a dwelling unit in a duplex occupied by the owner for a <br />minimum of six consecutive months per calendar year. <br />Section 26-82 — License Standards <br />(a) Regulation. No license may be issued unless all of the following are complied <br />with: <br />1. The owner shall ensure that the occupants and ,guests of a rental unit do not create <br />unreasonable noise or disturbances engage in disorderly conduct or violate <br />provisions of the City of Orono Code or any State law pertaining to noise, <br />disorderly conduct, overcrowding, the consumption of alcohol, or the use of <br />illegal drugs. Owners are expected to take any measures necessary to abate <br />disturbances including, but not limited to directing the occupants and guests of a <br />short term rental unit to cease the disturbing conduct, removing the occupant and/ <br />or guests or taking any other action necessary to immediately abate the <br />disturbance. <br />2. The owner shall ensure that the property comply with all applicable codes <br />regarding fire, building, and safety. <br />3. The owner shall provide a twenty- four (24) hour emergency contact that will be <br />available to respond to issues at the rental property within sixjy (60) minutes to <br />complaints regarding the condition, operation, or conduct of occupants of a rental <br />unit. <br />4. The rental property must have a visible house number easily seen from the street <br />day and night. <br />5. All advertising for the rental shall include the City issued license number. <br />6. The primary overnight and daytime occupant of a rental unit must be an adult <br />eighteen 18 years of age or older. This adult must provide a telephone number to <br />the owner and shall be accessible to the owner by telephone at all times. <br />7. Two off street parking spaces shall be provided at minimum. The maximum <br />number of vehicles allowed at a rental property shall be limited to the number of <br />available off street parking spaces. <br />8. The owner of a rental propertyshall hall provide sufficient trash collection containers <br />and service to meet the demand of the occupants. <br />9. The City may conduct an inspection of the rental property as deemed necessary or <br />prudent including without limitation based upon any complaints or violations that <br />occur or prior to a renewal of a permit. <br />10. The owner will be required to provide the city and any guests with the name <br />and telephone number of a contact person who can be at the property in n 60 <br />minutes. The contact person can be the owner. <br />(b) License period. Licenses shall expire December 31 of each year. <br />Page 2 of 3 <br />
