It , 4,
Christine Mattson
From: Christine Mattson
Sent: Friday, September 16,2016 10:55 AM
To: 'Kirk E.Johnson'
Subject: FW:2560 Old Beach Road Retaining Wall w/in City ROW
Attachments: 2560 Old Beach Rd.pdf,Zoning Permit Application May 2015.pdf
Based on the information we have, the property line is about 20 feet from the edge of pavement(see attached copy).
Retaining walls are required to be located within property boundaries. A Zoning Permit is required for Retaining Walls
over two feet in height and less than 5 feet from the property line. Encroachment into the City ROW might be allowed
given appropriate justification; however, its current location approximately 18"from the edge of the pavement is too
close and is not allowed. This proximity to the paved surface is not likely to be approved.
There are three options:
• Remove the retaining wall and restore all disturbed areas and establish with vegetation. Install silt fence or
other erosion control measures until vegetation has been established;
• Apply for Retaining Wall permit including all required submittals(a Zoning Permit Application is attached). This
option would involve moving and reinstalling the retaining wall on private property.
• Provide a survey to demonstrate that the property line information we have is incorrect.
Please don't hesitate to contact us with any questions.
Christine Mattson
Planning Assistant
City of Orono
2750 Kelley Parkway I Orono MN 155356(physical address)
PO Box 66 1 Crystal Bay I MN 155323-0066(mailing address)
9 952.249.4620 A 952.249.4616
®cmattson@ci.orono.mn.us -S www.ci.orono.mn.us
Office Hours: Monday-Friday 8 am to 4:30 pm
OUR OFFICE WILL BE CLOSED: Friday, November 11,2016
Thursday&Friday, November 24&25,2016
From: Kirk E.Johnson [mailto:keiohnson@mchsi.coml
Sent: Friday,September 16, 2016 8:54 AM
To:Christine Mattson<CMattson@ci.orono.mn.us>
Subject: Fwd: 2560 Old Beach Road Proposal
1
