icL®A CITY OF ORONO <br /> RESOLUTION OF THE CITY COUNCIL <br /> y � NO. 683 3 <br /> -ikESHoo' <br /> WHEREAS, the Applicant has made application to the City of Orono for a <br /> conditional use permit pursuant to Orono Municipal Zoning Code Section 78-1437 to allow the <br /> installation of plumbing consisting of a bathroom with bathing facilities within a detached <br /> accessory garage; and <br /> WHEREAS, the Applicant has made application to the City of Orono for a <br /> conditional use permit pursuant to Orono Municipal Zoning Code Sections 78-967 and 78-1126 <br /> to permit grading and filling on the property in excess of 500 cubic yards for mitigation of areas <br /> below the 1% annual chance floodplain in order to develop the property; and <br /> WHEREAS, on April 17, 2017, after published and mailed notice in accordance with <br /> Minnesota Statutes and the City Code, the Planning Commission held a public hearing, at which <br /> time all persons desiring to be heard concerning this application were given the opportunity to <br /> speak thereon; and <br /> WHEREAS, on April 17, 2017, the Planning Commission recommended approval <br /> of the variances and conditional use permits; and <br /> WHEREAS, on May 8, 2017, the City Council reviewed the application and the <br /> recommendations of the Planning Commission and City staff; and <br /> WHEREAS, on May 8, 2017 the City Council of Orono, Minnesota hereby adopted <br /> Resolution No. 6759 which approved the requested variances and conditional use permits as <br /> described above based on one or more of the below findings of fact concerning the Property; and <br /> WHEREAS, in September 2017, William F. Wanner Jr., and Kathleen A. Wanner, <br /> a married couple (hereinafter the "Owners"), purchased the Property from Toles and have <br /> accepted the conditions outlined herein. <br /> FINDINGS OF FACT: <br /> 1. This application was reviewed as Zoning File #17-3918. The analysis contained within <br /> staff memos and the exhibits attached to the aforesaid memos, all minutes from the above <br /> mentioned meetings, and any and all other materials distributed at these meetings are <br /> hereby incorporated by reference. <br /> 2. The Property is located in the LR-1A Single Family Lakeshore Residential Zoning District. <br /> 3. The Property contains 1.27 acres in area and has a defined lot width of 176 feet of width <br /> at the OHWL and 180 feet at the 75-foot setback. <br /> 2 <br />
