The property owner proposes to use the property in a reasonable manner not <br /> permitted by the Zoning Chapter. <br /> The proposed use is the construction of a modest sized single family home with a minimally sized <br /> garage. It is consistent, though similarly smaller than homes in the surrounding neighborhood. <br /> 2. The plight of the landowner is due to circumstances unique to his property not <br /> created by the landowner. <br /> The lot is one of the smallest in the neighborhood.Due to the curvature of the lakeshore and the <br /> location of the street,the property is at the pinch point of the two, creating a shallower lot than the <br /> surrounding properties. <br /> 3. The variance,if granted,will not alter the essential character of the locality. <br /> The proposed home is consistent in character and size with the surrounding homes. <br /> 4. Economic considerations alone do not constitute practical difficulties if reasonable <br /> use for the property exists under the terms of the Zoning Chapter. <br /> Economic considerations have not been considered as part of our request.The design of the <br /> home has been driven by needed functionality for the homeowner—indoor storage for their cars, <br /> minimal garage space for lawn and snow removal equipment, an elevator due to the fact that the <br /> bedrooms are on the upper level,and not possible to have on the main leveL Also,due to the water <br /> table,there cannot be a basement in the home,and the proposed crawl space is a short 4 ft tall. <br /> 5. Practical difficulties include, but are not limited to,inadequate access to direct <br /> sunlight for solar energy systems.Variances shall be granted for earth sheltered <br /> construction as defined in Minnesota Statutes, Section 116J.06, Subd. 2,when in <br /> harmony with this chapter. <br /> This does not apply. <br /> 6. The Board of Appeals and Adjustments or the Council may not permit as a variance <br /> any use that is not allowed under this Chapter for property in the zone where the <br /> affected person's land is located. <br /> This does not apply. Our use is permitted. <br /> 7. The Board or Council may permit as a variance the temporary use of a one-family <br /> dwelling as a two-family dwelling. <br /> This does not apply. <br /> 8. The special conditions applying to the structure or land in question are peculiar to <br /> such property or immediately adjoining property. <br /> The lot is one of the smallest in the neighborhood.
