The proposed <br /> location of the solar array is within a heavily screened area of the yard,maintaining setbacks from <br /> adjacent property lines. Further,a ground mounted array will be screened from Stubbs Bay road. <br /> The nearest adjacent home, 3625 Jacobs Mill Road, is 375 feet from the array. <br /> State statute seems to clearly protect a property owners' interest in solar energy. Placing of the <br /> array on the home would not negate the need for a variance, as due to the roof slope, and <br /> orientation, a variance would be required not be flush with the roof. <br /> Public Comments <br /> To date, no public comments have been received. <br /> Issues for Consideration <br /> 1. Does the Planning Commission find that that the property owner proposes to use the <br /> property in a reasonable manner which is not permitted by an official control? <br /> 2. Does the Planning Commission find that the variance, if granted, will not alter the <br /> essential character of the neighborhood? <br /> 3. Does the Commission find it necessary to impose conditions in order to mitigate the <br /> impacts created by the granting of the requested variance(s)? <br /> 4.
