• <br /> MINUTES OF THE <br /> ORONO PLANNING COMMISSION MEETING <br /> Monday,March 20,2017 <br /> 6:30 o'clock p.m. <br /> Thiesse commented that is a good idea. Thiesse stated if the person is proposing something right up to <br /> the setback line,the City should perhaps require a survey. <br /> Schoenzeit stated there could also be a statement that the applicant is responsible for locating it in the <br /> correct spot and that they may still need a survey or they will have to move it at their expense if it is in the <br /> wrong spot. Schoenzeit stated the issue is that the City is not always diligent with their enforcement. <br /> Thiesse stated he understands what Commissioner Schoenzeit is saying,but that the City has required in <br /> the past structures to be moved if it is in the wrong location. <br /> Schoenzeit commented with this permission comes some responsibility. Schoenzeit stated in his view it <br /> will happen and that it goes back to pitting neighbor against neighbor. Schoenzeit stated in his view it is <br /> crazy to ask for a $3,000 survey for a$500 shed,but at the same time,a person still has to put it in the <br /> right spot. <br /> Thiesse stated this gives them permission to put it in the right spot,and if it is not in the right spot,it <br /> would need to be moved. <br /> Lemke asked what would happen if they place it eight feet from the property line,there is no survey,and <br /> the neighbor complains. Lemke asked whose responsibility it would be to prove that the shed is not in the <br /> proper location. <br /> Thiesse commented it would be in the proper location until proven otherwise. <br /> Barnhart stated he would ask the person who registers a complaint where he feels the property line is. If <br /> that differs from what the other property owner says,it then it becomes a dispute between Property Owner <br /> A and Property Owner B. If it turns out that Property Owner B is correct,the shed would need to be <br /> relocated. <br /> Lemke stated the only way to prove that would be for someone to obtain a survey. <br /> Thiesse stated the City is only allowing a shed at a specific location but they are not getting involved in <br /> where the property line is. Thiesse stated requiring a survey for everything is time-consuming and <br /> expensive and a lot of times unnecessary. Thiesse stated if the structure has a permanent foundation,it is <br /> a different story in how easy it can be moved. <br /> Barnhart stated that could happen now with surveys and that it is something that will have to be dealt <br /> with. Barnhart indicated Staff is attempting to have a balance between the 100 cases where it is not a <br /> problem with the two cases where it is a problem. Barnhart stated more inaccuracy is introduced with <br /> less time and expense. <br /> Thiesse stated he is willing to try it. <br /> Leskinen commented it puts some responsibility on the applicant,which is where it should be. <br /> Chair Thiesse opened the public hearing at 9:54 p.m. <br /> There were no public comments regarding this application. <br /> Page 34 of 43 <br />
