MINUTES OF THE <br /> ORONO PLANNING COMMISSION MEETING <br /> Monday,March 20,2017 <br /> 6:30 o'clock p.m. <br /> Phillip and Darcy Otto,Applicants,were present. <br /> Curtis stated the applicants are proposing to expand the main floor of their home on the northwest with a <br /> 16' x 16' upper level addition to be constructed on posts. It will not encroach closer to the side lot line <br /> than the home currently is and,in fact,will be located further away. The home is set back three-tenths of <br /> a foot from the lot line. With the proposed offset,the addition to the rear of the home will be as close as <br /> three feet from the lot line where a 10-foot setback is required. <br /> Staff finds that the nonconforming location of the house and the angled lot lines result in limited to no <br /> expansion opportunities,which constitutes a practical difficulty with respect to making any improvements <br /> or changing the footprint. The proposal to construct the addition on posts will continue the existing <br /> drainage patterns. The variance is supported by practical difficulties. <br /> Planning Staff recommends approval of the variance. <br /> Curtis noted comments were received from the neighbor and are included in the packet. <br /> The Planning Commission had no questions for Staff. <br /> Phillip Otto,Applicant,stated the most level spot to put an addition off of the back of the house would be <br /> the west side,which would be the right side on the overhead. Otto indicated they will not be finishing the <br /> lower level but will just be using the footings. Otto stated the proposed location is basically the only spot <br /> for an addition. <br /> Chair Thiesse opened the public hearing at 8:41 p.m. <br /> There were no public comments regarding this application. <br /> Chair Thiesse closed the public hearing at 8:41 p.m. <br /> Landgraver moved,Leskinen seconded,to recommend approval of Application No. 17-3914,Phillip <br /> and Darcy Otto,4116 Highwood Road,granting of a side yard setback variance. VOTE: Ayes 5, <br /> Nays 0. <br /> 9. 17-3915 LECY BROTHERS ON BEHALF OF CHARLIE AND NORA DAUM, 1920 <br /> FAGERNESS POINT ROAD,VARIANES,8:42 P.M.—8:53 P.M. <br /> Andy Johnsrud,Lecy Brothers,was present. <br /> Gaffron stated the applicants are requesting approval of variances to the required lot area,the 0-75 foot <br /> hardcover, street setback, and lakeshore setback,in order to construct a new residence to replace the <br /> existing residence on the property. The property is located on the south side of Fagerness Point Road and <br /> the existing survey depicts the current house. <br /> The applicants submitted an application in 2016 for variances needed to construct an addition that was <br /> built in 1071. Due to water issues,it was determined a total rebuild would likely be necessary. Gaffron <br /> noted those conditions are illustrated in some photographs provided by the applicant. As a result of the <br /> water issues,the elevation of the home will need to be raised and a total rebuild is necessary. <br /> Page 23 of 43 <br />
