13Lou fAQ4cL <br /> CITY OF BROOKLYN PARK—INTERIM USE ORDINANCE <br /> §152.193 PURPOSE. <br /> The purpose of allowing interim uses is: <br /> g (A) To allow a use for a brief period of time until a permanent location is obtained or while the <br /> permanent location is under construction. <br /> (B) To allow a use that is presently judged acceptable by the City Council,but that with anticipated <br /> development or redevelopment,will not be acceptable in the future or will be replaced in the future by <br /> a permitted or conditional use allowed within the respective district. <br /> (C) To allow a use which is reflective of anticipated long range change to an area and which is in <br /> compliance with the comprehensive plan provided that said use maintains harmony and compatibility <br /> with surrounding uses and is in keeping with the architectural character and design standards of existing <br /> uses and development. <br /> (Ord.2005-1049, passed 9-26-05) <br /> § 152.194 PROCEDURE. <br /> Uses defined as interim uses shall obtain an interim use permit and shall be processed according to the <br /> standards and procedures for a conditional use permit as established in§ 152.035. <br /> (Ord. 2005-1049,passed 9-26-05) <br /> §152.195 GENERAL REQUIREMENTS. <br /> An interim use shall comply with the following: <br /> (A) Meet the standards of a conditional use permit set forth in§ 152.035. <br /> (B) State that certain date or event that will terminate the use. <br /> (C) Shall not impose additional unreasonable costs on the public. <br /> (D) Interim uses are waived from compliance with the Highway Overlay District standards. <br /> (E) All lots served by an individual/private sewer and water system must abandon the individual <br /> system and be connected to the public sanitary sewer and water when there is a change in the use of <br /> the property, or within one year of the date the public system becomes available to the lot,whichever <br /> occurs first. <br /> t- (F) Meet any conditions that the City Council deems appropriate for permission of the use. <br /> (G) Interim use permits shall be annually reviewed by the City Council. <br /> (Ord. 2005-1049, passed 9-26-05) <br /> § 152.196 TERMINATION. <br /> An interim use permit shall terminate on the happening of any of the following events,whichever occurs <br /> first: <br /> (A) The date stated in the interim use permit. <br /> (B) Upon violation of conditions under which the permit was issued. <br /> (C) Upon change in the city's zoning regulations,which render the use nonconforming. <br /> (D) The redevelopment of the use and property. <br /> (Ord.2005-1049, passed 9-26-05) <br />
