87 <br /> 88 (i) The applicant agrees in writing to any conditions that the City Council deems appropriate <br /> 89 for the use,including a requirement for a financial security to ensure removal of all evidence <br /> 90 of the use upon termination, and restoration of the site to prior or better conditions. The <br /> 91 conditions shall be set forth in a development agreement between the property owner and the <br /> 92 City, which agreement shall be recorded with the Hennepin County Recorder or Registrar of <br /> 93 Deeds. <br /> 94 <br /> 95 Sec. 78-1728. -Effect of Permit. <br /> 96 <br /> 97 (a) An interim use permit is effective only for the location specified in the approval <br /> 98 documentation. <br /> 99 <br /> 100 (b) The issuance of an interim use permit does not confer on the property any vested rights. <br /> 101 <br /> 102 (c)Interim use permits shall be reviewed annually by the City Council. <br /> 103 <br /> 104 (d)An interim use permit expires one year after approval if the proposed use has not been <br /> 105 commenced or a building permit for a structure to support the interim use has not been <br /> 106 issued. <br /> 107 <br /> 108 (e) An interim use permit expires if the interim use ceases operation for a continuous period <br /> 109 of at least one year. <br /> 110 <br /> 111 Sec. 78-1729.—Termination. An interim use permit expires and the interim use shall <br /> 112 terminate upon the occurrence of any of the following events: <br /> 113 <br /> 114 (a) The termination date specified in the interim use permit. <br /> 115 <br /> 116 (b) Upon violation of conditions under which the permit was issued. <br /> 117 <br /> 118 (c) Upon change in the City's zoning regulations which renders the use nonconforming. <br /> 119 <br /> 120 (d) The redevelopment of the use and property upon which it is located to a permitted or <br /> 121 conditional use as allowed within the respective zoning district. <br /> 122 <br /> 123 <br /> 124 SECTION 2.EFFECTIVE DATE.
