PC Exhibit A <br /> 17-3924 <br /> March 20, 2016 <br /> ORDINANCE NO. , THIRD SERIES <br /> CITY OF ORONO <br /> HENNEPIN COUNTY, MINNESOTA <br /> AN ORDINANCE AMENDING THE CODE OF ORDINANCES <br /> PERTAINING TO THE REVIEW OF CONDITIONAL USE PERMITS UPON <br /> NEIGHBORS PETITION <br /> THE CITY COUNCIL OF ORONO ORDAINS: <br /> SECTION 1. Section 78-921 shall be amended by striking text to read as follows: <br /> Sec. 78-921.—Conditional Use Permit Review . <br /> The City hereby reserves the right to inspect the premises where a Conditional Use permit <br /> has been issued, after receiving permission from the property owner or receiving the appropriate <br /> court order, to ensure compliance with the provisions of this Ordinance or and conditions <br /> imposed. . . _ ._ -- -- - - .. - -• • - - - - . . .. _ <br /> of change or revocation unless such a review is one of the conditions of the original permit or <br /> unless the actual land use is determined to be in violation of the terms of the permit.however, <br /> upon petition of 75 percent or more of the adjacent property owners (defined here as those <br /> whose property lies within 1,000 feet of the property subject to the conditional use permit), the <br /> council shall hold a public hearing on the continuation of the permit. The council shall <br /> determine, after such public hearing, whether the continuation of the conditional use in question <br /> is consistent with the health, safety and general welfare of the residents of the city. The council <br /> relocate in a zone where such use is permitted. <br /> SECTION 2. EFFECTIVE DATE: This ordinance shall take effect immediately upon its <br /> passage and publication. <br /> ADOPTED this day of ,2017 on a vote of ayes and_nays by the <br /> City Council of Orono, Minnesota. <br /> ATTEST: <br /> Anna Carlson, City Clerk Dennis Walsh, Mayor <br /> Ordinance published in The Laker and The Pioneer newspapers the week of , 2017. <br />
