The granting of the proposed variance will not in any way impair health, safety, comfort <br /> or morals,or in any other respect be contrary to the intent of this chapter.The proposed <br /> project will not impair the health,safety,comfort,or morals of the public. <br /> 12. The granting of such variance will not merely serve as a convenience to the applicant,but <br /> is necessary to alleviate demonstrable difficulty.Granting of the variance will resolve and <br /> alleviate a demonstrated practical difficulty caused by the application of the lake <br /> setback as applied to the Property. <br /> The Commission may recommend or Council may impose conditions in granting of variances. <br /> Any conditions imposed must be directly related to and must bear a rough proportionality to the <br /> impact created by the variance. No variance shall be granted or changed beyond the use <br /> permitted in this chapter in the district where such land is located. <br /> Septic System Status <br /> The property is served by City sewer. <br /> Practical Difficulties Statement <br /> Applicant has completed the Practical Difficulties Documentation Form attached as Exhibit B,and <br /> should be asked for additional testimony regarding the application. <br /> Practical Difficulties Analysis <br /> The applicants' home was originally constructed nearly 100 years ago, since that time <br /> improvements have been made to the property.The large wetland on both sides of North Shore <br /> Drive, situated between the home and the lake likely pushed the applicants' home location, as <br /> well as the two adjacent homes,toward the lake at a time when maintaining a 75-foot separation <br /> from the lake was unheard of. <br /> Staff finds the practical difficulties inherent to the existing home's location and its current <br /> proximity to the lake may support the requested variances. The applicants' proposal, while <br /> encroaching into the lake setback, may be reasonable considering the desire to perpetuate the <br /> open space between the subject property and the neighbor to the east.The additional living space <br /> could be added to the home in a conforming manner however the open space between homes <br /> would be reduced by 15-20 feet;the existing trees and the open space currently serve as a buffer. <br /> Engineer Comments <br /> The City's engineer will conduct a thorough review at the time of the building permit. <br /> Public Comments <br /> Both of the adjacent neighbors are aware of the variance request;the property owner to the east, <br /> Jeff Andrade, has provided additional supportive comments. His comments are attached as <br /> Exhibit F. <br /> Issues for Consideration <br /> 1. Does the Planning Commission find that that the property owner proposes to use the <br /> property in a reasonable manner which is not permitted by an official control? <br /> 2. Does the Planning Commission find that the variance(s), if granted, will not alter the <br />
