O O CITY of ORONO <br /> At RESOLUTION OF THE CITY COUNCIL <br /> NO. 6 20 6 <br /> SH0 <br /> alley for a lake side deck where a 35-foot setback from the alley is normally required in <br /> conjunction with the construction of a new residence; and <br /> WHEREAS, in order to accommodate the proposed house location the grading of <br /> a swale is proposed on the bluff, down slope from the top of bluff in order to manage the <br /> stormwater on the Property; and <br /> WHEREAS, after due published notice and mailed notice in accordance with <br /> Minnesota Statutes and the Orono, Minnesota, City Code, the Orono Planning Commission held <br /> a public hearing on January 22, 2013 at which times all persons desiring to be heard concerning <br /> this application were given the opportunity to speak thereon. <br /> NOW, THEREFORE BE IT RESOLVED by the City Council of Orono, <br /> Minnesota: <br /> FINDINGS <br /> 1. This application was reviewed as Zoning File 12-3582. <br /> 2. The Property is located in the LR-113 One Family Lakeshore Residential Zoning <br /> District which requires a minimum lot area of 1.0 acres and a minimum lot width <br /> of 140'. <br /> 3. The Planning Commission reviewed this application at a public hearings held on <br /> January 22 and February 19, 2013 and recommended approval of the variances <br /> based on the following findings: <br /> a. The Property contains 11,752 square feet (0.26 acre) in area and has 60 feet <br /> in width at the OHWL and 60 feet in width at the 75-foot lake setback. <br /> b. Sanitary sewer is available. <br /> c. There is no additional land available to bring the lot area or lot width into <br /> conformity. <br /> d. Similar variances were granted by the City of Orono in 2006 by Resolution <br /> No. 5553 in conjunction with a lot line rearrangement application. Those <br /> variance approvals have zince expired. <br /> e. VVith the exception of a greater setback variance request for a 10-foot <br /> setback from the alley (13-foot setback was granted in 2006), the Developer's <br /> Page 2 of 6 <br />
