r <br /> O TRANSFER ENTERED <br /> HENNEMN COUNTY TAXPAYER SERVW <br /> 0 "Al Z 2 2010 <br /> CITY of ORONO <br /> y H N �I TY MI <br /> pLUTION OF THE CITY COUNCIL <br /> NO. 5 -� <br /> A RESOLUTION RENEWING <br /> A SUBDIVISION OF A LOT LINE <br /> REARRANGEMENT AND <br /> VARIANCES FOR PROPERTIES LOCATED AT <br /> 4725 AND 4731 NORTH SHORE DRIVE <br /> FILE NOS. 06-3234& 06-3235 <br /> WHEREAS, on December 11, 2006, the City Council of the City of <br /> Orono (the"City") adopted Resolution No. 5553 granting approval for subdivision of <br /> a lot line rearrangement, vacation and variances for properties located at 4725 North <br /> Shore Drive and 4731 North Shore Drive; and <br /> WHEREAS, Resolution No. 5553 required the property deeds to be filed <br /> within six months of City Council approval, and failure to file deeds shall be <br /> considered as a formal withdrawal of the proposed subdivision; and <br /> WHEREAS, the lot line rearrangements, vacation and variance <br /> approvals run with the land,not the applicant; and <br /> WHEREAS, due to market conditions and other reasons the properties <br /> were foreclosed upon and returned to the Bridgewater Bank (hereinafter "owner"). <br /> Therefore, the owner has requested an additional one-year extension of the effective <br /> period of approval granted in Resolution No. 5553; and <br /> WHEREAS, the owner has requested a one year extension of the effective <br /> period of approval to January 25,2011. <br /> NOW, THEREFORE, BE IT RESOLVED by the City Council <br /> of the City of Orono,Minnesota, as follows: <br /> 1. The effective period of Resolution No. 5553 is hereby extended to <br /> January 25, 2011; and <br /> 2. An additional year is allotted for the filing of the deeds. <br /> 3. All other terms and conditions of Resolution No. 5553 are hereby <br /> reaffirmed. <br /> Page 1 of 2 <br /> �oX 72 <br />
