The site plan indicated the proposed setback 10'to the side property lines,30' <br /> to the rear property line which meet the minimum requirements of the LR-1B <br /> zoning district. <br /> C. The lot was platted prior to current zoning requirements. <br /> D. There is no additional land to combine with the property. <br /> E. The new residence will be in the same general location as the existing <br /> residence. <br /> F. The non-conforming location of the residence to the east leaves a small, <br /> approximately 15'wide building area meeting the average lakeshore setback. <br /> G. Drainage concerns expressed by the neighboring property owner can be <br /> addressed through suitable drainage and grading plan. <br /> 4. The City Council finds that the conditions existing on this property are peculiar to it <br /> and do not apply generally to other property in this zoning district;that granting the <br /> variance will not adversely affect traffic conditions,light,air,nor pose a fire hazard <br /> or other danger to neighboring property;would not merely serve as a convenience to <br /> the applicants,but is necessary to alleviate a demonstrable hardship or difficulty;is <br /> necessary to preserve a substantial property right of the applicants;and would be in <br /> keeping with the spirit and intent of the Zoning Code and Comprehensive Plan of the <br /> City. <br /> 5. The City Council has considered this application including the findings and <br /> recommendations of the Planning Commission,reports by City Staff,comments <br /> by the applicants and the effect of the proposed variances on the health, safety and <br /> welfare of the community. <br /> CONCLUSIONS, ORDER,AND CONDITIONS <br /> Based upon one or more of the above findings,the Orono City Council hereby grants <br /> a variance to Municipal Zoning Code Section 10.24, Subdivision 5 (B) to permit new residential <br /> construction on a.54 acre lot where 1 acre is required and an encroachment of 45' into the average <br /> Page 2 of 6 <br />
