Slip Rental Memo <br /> June 1, 1993 <br /> Page 2 <br /> Presuming we have enough information to show that his use can be defined as either a "business <br /> of docking, mooring or storing boats" or as "commercial boat dock business", Section 10.24, <br /> the LR-1B Zoning District, does not list either of these two business uses as being allowed uses <br /> in the LR-1B Zone. Therefore we have two courses of action: <br /> 1. Issue a citation for violation of Section 5.42, Subd. 2 for engaging or <br /> participating in a business use without first having obtained a license from the <br /> City. <br /> 2. Issue a citation for violation of Section 10.24, Subds. 2, 3 and 4, for operating <br /> a use that is not allowed in the LR-113 Zone. <br /> If we tag for not having a business use license, we should make it clear to Grotans that it is a <br /> virtual certainty that he will not be granted such a license should he apply for one. The City <br /> does not license this type of business use in residential zones. <br /> I am attaching the advertisement which Jim Lorence faxed to me, and a copy of Section 5.42, <br /> Subds. 1, 2 and 3, and a copy of Section 10.24, the LR-1B District requirements. <br /> Once we have verified who owns all the boats and taken some pictures, I would recommend you <br /> follow through with your standard violation procedure, but don't give this guy all summer to <br /> make these rental boats go away. <br /> If this actually ends up in Court, it will be a good test of whether our licensing and zoning code <br /> provisions on private slip rental have any teeth. <br /> ch <br />
