MINUTES OF THE <br /> ORONO PLANNING COMMISSION MEETING <br /> Monday,April 17,2017 <br /> 6:30 o'clock p.m. <br /> The City of Andover allows the temporary processing and storage of sand, gravel,or other materials. In <br /> addition, Chisago City allows temporary processing or recycling plant in conjunction with a specific <br /> project. <br /> Adding the ability to allow for specified interim uses within specified zoning districts gives the City and <br /> property owners a method or tool for the temporary use of property. It provides an option for properties <br /> that are expected to be developed in the future in conformity with the zoning code, but for various reasons <br /> such future development will not occur immediately. As it relates to the Eisinger property,the developer <br /> has gained preliminary plat approval for housing, but does not anticipate actual development of the site <br /> for a number of years. <br /> An example of how an interim use permit could have been used in Orono was the former produce market <br /> at County Road 6 and Highway 12. That site was zoned for single-family use and was operating via a <br /> "nonconforming use conditional use permit" in the 1960s. Later conditional use permits were approved <br /> for minor expansion of the market use. When the market closed,the building eventually became a <br /> daycare center via a new conditional use permit. When MnDOT determined that the property would be <br /> needed for the Highway 12 bypass, the daycare use discontinued but it was a number of years before that <br /> part of the bypass was constructed. As a result, the building sat empty for a number of years. Because <br /> the City had no interim use ordinance, any temporary use of the site was not allowed. <br /> Potential disadvantages of an interim use permit include property owners proposing land uses that are <br /> inappropriate for a given site or disruptive to the neighboring property owners or would be inconsistent <br /> with the character of the surrounding area. If the Council approves an amendment to the Zoning Code to <br /> allow interim uses,the City, developers and the property owners will have to be very clear about the <br /> parameters for such use. Clear and concise documentation of the allowed land use,activities and time <br /> periods will be required with each IUP issued. The City must be diligent not only in establishing <br /> appropriate interim uses within specified zoning districts but in monitoring those uses for compliance <br /> with the established terms of each issued IUP. <br /> Before the Planning Commission tonight is a draft ordinance. This is drafted similar to the general code <br /> section on conditional uses. It contains language that mimics the state statute on interim uses and also <br /> contains certain provisions that should pertain to all interim use permits. Sample ordinances from other <br /> cities are also attached. Gaffron stated while the ordinances differ widely,there are four common <br /> elements: A definition purpose and intent; application procedures; standards and conditions; and a <br /> termination clause. <br /> Gaffron noted the companion application to the text amendment includes a request for an interim use <br /> permit in the RR-1B, Single Family Rural Residential Zoning District. The applicant is proposing <br /> temporary use of the property at 3245 Wayzata Boulevard fo staging of construction activities associated <br /> with the County Road 112 improvement project. <br /> The Planning Commission should review the provided information and discuss the advantages and <br /> disadvantages of having an interim use option in the zoning code and review the draft text amendments. <br /> The Planning Commission should also identify any specific concerns about the proposed construction <br /> staging/materials recycling use and suggest any additional conditions that might be applicable. <br /> The Planning Commission had no questions for Staff. <br /> Page 10 of 48 <br />
