MINUTES OF THE <br /> ORONO PLANNING COMMISSION MEETING <br /> Monday,March 20,2017 <br /> 6:30 o'clock p.m. <br /> Curtis stated the owner is planning to redevelop the property and would like to construct a new home with <br /> a lakeside terrace. The existing home improvements will encroach as much as 11 feet lakeward of the <br /> average setback line. The new home is proposed to encroach approximately 30 feet lakeward of the <br /> average lakeshore setback line and the new elevated terrace is shown with as much as a 40-foot <br /> encroachment toward the lake. <br /> The home on the north side sits higher than the applicant's property and is situated further back from the <br /> lake than the majority of the neighboring homes along the shoreline. The lot is only 100 feet in width <br /> where 140 feet is required. Because the applicant is requesting an average lakeshore setback variance,the <br /> lot width variance cannot be administratively approved. <br /> Comments from the neighbors were received and are supportive of the project. <br /> Staff finds there are practical difficulties supporting the lot area and lot width variance as well as the <br /> average lakeshore setback variance requests. Planning Staff recommends approval. <br /> The Planning Commission had no questions for Staff. <br /> Peter Eskuche,Applicant, stated the house is further from the lake than the homes on the other adjoining <br /> properties. The property to the north was constructed approximately 100 feet from the lake,which makes <br /> it out of context with the rest of the neighborhood. <br /> Eskuche stated the red line outlines the existing home,which is quite a bit closer to the property to the <br /> north and the lake than the proposed home. Eskuche stated they are attempting to meet the intent of the <br /> Code but that it is difficult since the location of the home to the north is unusual. <br /> Thiesse noted those property owners did write a letter in support of the project and the location of the <br /> proposed home. <br /> Thiesse asked if there will be a new driveway. <br /> Eskuche indicated there will be. <br /> Gustafson noted it is currently a shared driveway with the property to the north. <br /> Thiesse asked whether that neighbor will be able to use the old driveway. <br /> Gustafson stated there is no plan to move the driveway at this point and it is to be determined. <br /> Chair Thiesse opened the public hearing at 8:58 p.m. <br /> There were no public comments regarding this application. <br /> Chair Thiesse closed the public hearing at 8:58 p.m. <br /> Schoenzeit asked if the Planning Commission would approve this if the neighbor to the north said they <br /> were not supportive of it. <br /> Page 26 of 43 <br />
