MINUTES OF THE <br /> ORONO PLANNING COMMISSION <br /> Tuesday,February 21,2017 <br /> 6:30 o'clock p.m. <br /> Landgraver asked whether there is an easement that exists for access across the adjoining property at <br /> 2120. <br /> Richardson stated there were some access agreements by the old owner but that he does not know <br /> whether they are still applicable. Richardson indicated his preference would be to go right out onto <br /> Wayzata Boulevard. <br /> Thiesse commented daycare would be a wonderful use of the building. <br /> Landgraver stated he would prefer to rely on the state licensing requirements. <br /> Thiesse stated in his view Orono's daycare standards should be removed from the code and they should <br /> just rely on the state regulations. <br /> Gaffron stated Orono's standards only apply to the B-1 and B-3 districts at this time. <br /> Landgraver moved,Olson seconded,to recommend approval of Application No. 17-3899,Little <br /> Acorns Child Care,2060 Wayzata Boulevard West,granting of a conditional use permit,subject to <br /> Staff recommendations. VOTE: Ayes 6,Nays 0. <br /> 4. #17-3900 SCOTT KIRCHNER, 1090 HERITAGE LANE,VARIANCE,7:16 P.M. 7:24 <br /> P.M. <br /> Scott Kirchner, Applicant, was present. <br /> Curtis stated the subject property is an existing lot of record that is substandard in size for the LR-1A <br /> district. The lot was created in 1965 as part of the Foxhill neighborhood which predates the creation of <br /> the 2-acre minimum requirement. The lot currently consists of 0.98 acre in area. <br /> In addition, the applicant has made an application for a subdivision exemption to allow an administrative <br /> lot line rearrangement between the subject property and the Nelson property at 1780 Shoreline Drive. <br /> The proposed lot line adjustment would increase the size of the subject property to 1.07 acres but would <br /> still not meet the requirement of the district. The additional land will make the buildable area larger and <br /> possibly avoid setback variances for the development of the lot in the future. A lot area variance is <br /> needed in order to process the subdivision exemption. <br /> Staff finds there are demonstrable practical difficulties supporting the lot area variance. <br /> Planning Staff recommends approval of the lot area variance. <br /> The Planning Commission had no questions for Staff. <br /> Scott Kirchner, Applicant, stated the survey shows some of the difficulties that were encountered with the <br /> lot, including a wetland near Heritage Lane. Due to that wetland and the building setbacks,the lot is very <br /> limited with regard to the building envelope. Kirchner stated by purchasing the adjoining property, it will <br /> help square off the lot and eliminate some of the future complications with the building pad. <br /> Landgraver stated it is a reasonable solution to a challenging problem. <br /> Page 8 of 32 <br />
