MINUTES OF THE <br /> ORONO PLANNING COMMISSION <br /> Tuesday,February 21,2017 <br /> 6:30 o'clock p.m. <br /> Schoenzeit asked what the permit approval process is. <br /> Barnhart indicated there is a review process outlined in Section 66-223, which describes what is required <br /> on the application, and Section 66-225 talks about how the City can deny a permit. <br /> Schoenzeit asked if there is some delay in getting a permit. <br /> Barnhart indicated the permits are approved by the City Council. Barnhart noted permits will <br /> automatically be denied if the request is not received 14 days prior to the event being held. Barnhart <br /> indicated that is because there must be notice provided to residents within 350 feet at least ten days prior <br /> to the special event. <br /> Barnhart noted that would not apply to private events. Under the draft ordinance, residents would be <br /> allowed to hold three private events with the fourth one requiring a permit. <br /> Schoenzeit asked if Item No. 3 in 66-225 applies to all city ordinances or just zoning. <br /> Barnhart indicated it would just be zoning. <br /> Schoenzeit asked if that will be changed with this ordinance. <br /> Barnhart stated that is not proposed to be changed. <br /> Thiesse commented that seems odd and that technically it would be all ordinances. <br /> Barnhart stated some events are held in the event and have live music. Those events in theory would <br /> violate city ordinances and would need special City permission. In addition, launching fireworks is <br /> against city ordinance unless a permit is obtained. <br /> Schoenzeit asked if there is any provision in the event a request for a special event permit has been <br /> previously denied that would force it to go to the City Council. <br /> Schoenzeit stated Staff cannot approve a special event permit and it must go before the City Council. <br /> Schoenzeit asked if there would be a public hearing in connection with that permit. <br /> Barnhart stated typically there are not public hearings on special event permits but that notice is provided <br /> to the residents located within 350 feet of the event. <br /> Chair Thiesse opened the public hearing at 9:56 p.m. <br /> There were no public comments regarding this application. <br /> Chair Thiesse closed the public hearing at 9:56 p.m. <br /> Lemke moved, Leskinen seconded,to recommend approval of Application No. 17-3897,City of <br /> Orono,Text Amendment: Special Events.
