Cleveland Trust Dated 10-14-Q8 (hereinafter referred to as the"Applicant") ; <br /> and the City of Orono,a Minnesota.municipal corporation(hereinafter referred to as the <br /> «Cl�,,,� , <br /> � <br /> WITNESSETH: <br /> WHEREAS,the Applicant has made an application,pursuant to Building Pezmit 2013- ; <br /> 00471,to the City for demolition of the�rincipal residence structure an�two acc�s�o�y <br /> structures on the property l�cated at 431�North S�aore D,rive,and such propeFty is legaiiy � <br /> described on Exhibit"A"(hereinafter referred to as"Subject Property"); and <br /> WHEREAS,the Applicant is the owner of the Subject Property; and <br /> WHEREAS,the Subject Property contains a principal residence staructure,two detached <br /> accessory structures,a boat house, concrete pad, deck and stairs withi.n the 0-75' zone <br /> (hereinafter referted to as "Nonconforming Accessory Structures") shown on the survey or site <br /> plan attached hereto as E�chibit"B"; and <br /> WHEREAS,Appiicant is aware that according to Orono Municipal Zoning Code <br /> Sections 78-1432, at the time fhe principal structure zs removed,all nonconfoxming accessory <br /> structures shall also be removed; and <br /> WHEREAS,the ordinances of the City require removal of all accessory structures at the <br /> dme of removal of the principal structure,because such accessory structures may become a <br /> public nuisance due to lack of on-site property control and management; and <br /> WHEREAS,the Applicant intends to,upon demalition of the principal structure and two <br /> accessory structures, immediately replace the principal structuxe and two accessory structures <br /> with a new principal residence with an attached garage and build a separate detached garage on <br /> the site; and <br /> WHEREAS,at the Applicant's request,the City intends to a11ow the Nonconforming <br /> Accessory Structures to remain on the Subject Property during demolition of the existing <br /> principal structuze and two accessory structures with the expectation that a new principal <br /> structure with an attached garage and a new detached garage will be constructed. <br /> NOW,THEREFORE,THE PARTIES TO THIS AGREEMENT AGREE TO THE <br /> FQLLOWING: <br /> 1. The Applicant may retain the existing Nonconforming Accessory Structures, subject to <br /> the following conditions: <br /> A} Applicant agrees to obtain a building permit for canstruction of the replacezn�ent <br /> residence within sixty(60) days of demolition;to begin construction on the new <br /> t�o�oo <br />
