I <br /> realized I had misunderstood the plans and as a result a portion of the owner's suite cantilever is in error. <br /> When I reviewed the plans for the building permit I though the westerly wall of the second floor was set <br /> in 18 inches from the wall of the first floor so the eave extended 18 inches from the first floor wall. As <br /> you may recall,you had to reduce the eave on the east side from 24 inches to 18 inches because only an <br /> 18 inch encroachment into the 10 foot setback is allowed. The code was recently changed to allow a two <br /> � foot encroachment so there is no problem with the eave along the westerly side of the house. However <br /> there is a problem with the cantilevered area of the owner's suite. My misunderstanding of the plan <br /> places the westerly 18 inches of this area within the average lakeshore setback. The average lakeshore <br /> setback was for the decks steps only.I have discussed the situation with Soren Mattick,the City Attorney, <br /> he indicated and I concurred that since there is no variance for it the portion of the cantilever than is <br /> within the average lakeshore setback must be removed. <br /> I apologize for my error.
