T e Orono Planning Commission reviewed this application in <br /> an earlier application involving increases in hardcover <br /> within the 75-250' setback area in 1986 (File #1088 ). <br /> Hardcover inventory was determined by the Orono staff and <br /> was reported at 5, 907 s.f. or 28.6%. The current survey of <br /> hardcover by a licensed surveyor shows hardcover within the <br /> 75-250' setback area at 6, 990 s.f. or 38.6%. The applicant <br /> has added no additional improvements resulting• in increases <br /> in hardcover since the 1986 review. <br /> 4. The Orono City Council reviewed this application on April <br /> 27, 1992 and conceptually recommended approval of the <br /> proposed variance based upon the following findings: <br /> a) The proposed second story deck will not result in an <br /> increase in hardcover within the 75-250' setback area <br /> as the deck will be installed over an existing grade <br /> level patio. <br /> b) There has been no increase in hardcover since an <br /> earlier variance review in 1986 that involved approval <br /> of hardcover variances. <br /> c) Steep topographies of this property make it unfeasible <br /> to remove existing paved areas needed to provide <br /> adequate turnaround maneuverability on site. <br /> 5. The City Council finds that the conditions existing on this <br /> property are peculiar to it and do not apply generally to <br /> other property in this zoning district; that granting the <br /> variance would not adversely affect traffic conditions, <br /> light, air nor pose a fire hazard or other danger to <br /> neighboring property; would not merely serve as a <br /> convenience to the applicant, but is necessary to alleviate <br /> a demonstrable hardship or difficulty; is necessary to <br /> preserve a substantial property right of the applicant; and <br /> would be in keeping with the spirit and intent of the Zoning <br /> Code and Comprehensive Plan of the City. <br /> 6. The City Council has considered this application including <br /> reports by City staff, oral and written comments by the <br /> applicant and the effect of the proposed variance on the <br /> health, safety and welfare of the community. <br /> Page 2 of 5 • <br />
