The �ity Council finds that the conditions existing on this Property are peculiar to it and <br /> do nqt apply generally to other property in this zoning district; that granting the variances <br /> woulc�not adversely affect tra�c conditions, light,air nor pose a fire hazard or other danger <br /> to ne hboring property; would not merely serve as a convenience to the Owners, but is <br /> nece sary to alleviate a practical difficulty; is necessary to preserve a substantial property <br /> right f the Applicants; and would be in keeping with the spirit and intent of the Zoning <br /> Code nd Comprehensive Plan of the City. <br /> ; <br /> i <br /> CONCLUSIONS, ORDER AND CONDITIONS <br /> Based on th above fihdings, City Council of Orono, Minnesota hereby grants a variance from <br /> Orono City C de Secti�n 78-1279 to permit construction of a 4.5' x 6.5' elevator dormer 70 feet <br /> from the OH L where a 75-foot setback is required, subject to the following conditions: <br /> 1. Coun I approval is based on the survey and building plans submitted by the Applicants <br /> and a' notated by City staff, attached to this Resolution as Exhibits B � C. Any <br /> amen ments ta these plans may require further Planning Commission and City Counci� <br /> revieHr <br /> 2. Autho ties gran�ed by this resolution run with the Property not with the Applicants, but are <br /> permi ive onlyi and must be exercised by obtaining a building permit for the new <br /> constr ction and commencing construction of said project. A framing inspection must be <br /> compl ed withirn one year of the date of Council approval, or the variances witl expire on <br /> that da�e(December 12, 2017). <br /> 3. Violatiah of or non-compliance with any of the terms and conditions of this resolution shall <br /> constit te a vio�ation of the zoning code, shall automatically terminate any authority <br /> granted�herein, and shall be punishable as a misdemeanor. <br /> 4.
