We met Sean Tierney to discuss the unpermitted <br /> grading and filling activity conducted on your property. I explained to Tierney it was necessary to <br /> complete an after-the-fact land alteration permit application in order to move the project from an illegal <br /> project to a permitted project or the City would proceed with legal action. To date I have not received an <br /> after-the-fact application nor has Tierney been the City offices to resolve this issue. <br /> The October 7, 2010 survey submitted to the City, confirms a wetland existed in the southeast corner of <br /> your property where the illegal fill was deposited and grading was conducted. Additionally, the fill <br /> extends into the City and County rights-of-way. City Code Section 78-1608 (1)(c) prohibits filling within <br /> a wetland, and City Code Sections 18-2 and 18-196 prohibit deposit or excavation of materials within <br /> the right-of-way. Letters sent to you dated September 30, October 26 and November 22, 2010 required <br /> you to remove the fill and restore the site.
