The City Council fiilds that the conditions existin; on this property are <br /> peculiar to it and do not apply generally to other property in this zoning <br /> district; that grailting the vax7ance would not adversely affect traffic <br /> conditions, light, air nor pose a fire hazard or other danger to neighboring <br /> property; would not merely serve as a convenieilce to the applicant, but is <br /> necessary to alleviate a demonstrable hardship or difficulty; is necessary to <br /> preserve a substautial property right of the applicant; and would be in <br /> keeping with the spirit and intent of the Zoning Code and Comprehensive <br /> Plan of the City. <br /> CONCLUSIONS, ORDER AND CONDITIONS <br /> Based upoii oiie or more of tlle above fndin�s, the Orono City Council hereby <br /> grants a variaiice to Orono Municipal Zoning Code Section 78-350 Subdivision B, and <br /> 5ection 78-1288 Subdivision B to allow constnlction of a new single family residence oi1 <br /> a lot 10,000 s.f. in area and 50' iii width where 21,780 s.f. in area and 100' in width are <br /> � nomially required and hardcover witliin the 75'-250' setback zone of 36% where 25% is <br /> nomially allowed, subject to the following conditions: <br /> 1. Council approval is based on the site pla,�l subiliitted by tlie applicant and <br /> annotated Uy City staff, attached to this Resohrtion as Exhibit A. Any <br /> ainendinents to the site plai� which are not in conforniity with City codes will <br /> require fiirther Planning Commission and City Council review. <br /> 2. Hardcover in the 75-250' zone shall be limited to 2,274 s.f. or 36% per the <br /> proposed plan and hardcover allowance summary as depicted on Exhibit A. <br /> Hardcover within the 250'-500' zone sl�all be limited to 30% or 1,125 s.f. <br /> Applicant is advised that any filture requests to increase hardcover or change the <br /> natl�re of existing/approved hardcover shall require City approval, and increases <br /> in hardcover will not likely be approved without concui-rent reduction in existing <br /> hardcover. <br /> �� 3. Appticant-snall remove all plastic or fabric liner material from the decorative <br /> landscape beds on the property to ensure their penneability as non-hardcover <br /> surfaces. <br /> ' 4.
