CITY OF ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. 6 1 7 <br />A RESOLUTION <br />APPROVING A VARIANCE FROM <br />MUNICIPAL ZONING CODE <br />SECTION 78-350, 78-1680, 78-1700, 78-1282, 78-1279 <br />FILE NO. 17-3981 <br />WHEREAS, on September 20, 2017, Todd and Angie Olson ("Applicants"), applied <br />for a variance from the City Code for the property addressed 3325 Crystal Bay Road and legally <br />described as: <br />Lot 5, Wallace's Addition on the Village of Minnetonka Beach, Hennepin County, <br />Minnesota (hereinafter the "Property"); <br />WHEREAS, the Applicants have made application to the City of Orono for a <br />variance to Orono Municipal Zoning Code Section 78-350 to allow for a 6 foot rear yard setback <br />and 1.4 foot side yard setback; and <br />WHEREAS, the Applicants have made application to the City of Orono for a <br />variance to Orono Municipal Zoning Code Section 78-1680 to allow 50.9 foot lake yard <br />setback; and <br />WHEREAS, the Applicants have made application to the City of Orono for a <br />variance to Orono Municipal Zoning Code Section 78-1700 to allow to allow for 47.3% <br />hardcover; and <br />WHEREAS, the Applicants have made application to the City of Orono for a <br />variance to Orono Municipal Zoning Code Section 78-1282 to allow to allow for a driveway <br />width to exceed 8 feet; and <br />WHEREAS, the Applicants have made application to the City of Orono for a <br />variance to Orono Municipal Zoning Code Section 78-1279 to allow the home to encroach <br />in the average lakeshore setback; and <br />WHEREAS, on November 20, 2017, after published and mailed notice in accordance <br />with Minnesota Statutes and the City Code, the Planning Commission held a public hearing, at <br />which time all persons desiring to be heard concerning this application were given the opportunity <br />to speak thereon; and <br />WHEREAS, on November 20, 2017, the Planning Commission recommended <br />approval of the variance; and <br />
