���p CITY OF ORONO <br /> RESOLUTION OF THE CITY COUNCIL <br /> y�, `� No. 6 8 2 1 <br /> ��kFSH�Q`� <br /> 13. The City Council finds that the existing Easement area to be vacated has no apparent <br /> present or future benefit to the public. <br /> 14. The City has not and does not intend to develop, improve, or use the existing Easement <br /> area for open space purposes. <br /> 15. The unimproved Easement area as it exists serves no public purpose. <br /> CONCLUSIONS, ORDER AND CONDITIONS: <br /> Based upon one or more of the above findings, the Orono City Council hereby grants the <br /> variances, conditional use permits and easement vacations to Orono Municipal Zoning Code <br /> Sections 78-1605, 78-1282, 78-1126, 17-1286, 17-967, AND 78-1610 to allow wetland setback, <br /> driveway to exceed 8 feet in width, grading in the floodplain, land alteration in the lakeyard, land <br /> alterations in the shoreland overlay district, and wetland alterations subject to the following <br /> conditions: <br /> 1. Council approval is based on the entire record, above Findings. <br /> 2. The approved project shall conform to the submittal plans dated October 18,2017 and the <br /> easement legal descriptions submitted by the Applicants and annotated by City staff, <br /> attached to this Resolution as Exhibits A 8� B. <br /> 3. Any amendments to the plans which are not in conformity with City codes may require <br /> further Planning Commission and City Council review. <br /> 4. Authorities granted by this resolution run with the Property not with the Applicants, but are <br /> permissive only and must be exercised by obtaining the final plat approval for Ivy Place, <br /> or the variances, conditional use permits and easement vacations will expire once year <br /> from approval (December 11, 2018). <br /> 5. Violation of or non-compliance with any of the terms and conditions of this resolution may <br /> result in the termination of any authority granted herein. <br /> 6. Approval for the request variance shall be contingent upon the following: <br /> a. Final Plat Approval <br /> b. MCWD Approval of the wetland buffer reduction <br /> 7. Approval for the easement vacations stall be contingent on the following: <br /> a. Final Plat Approval <br /> 9 <br />
