���p CITY OF ORONO <br /> RESOLUTION OF THE CITY COUNCIL <br /> y�, G� No. 682 1 <br /> ��KfSHO�� <br /> 14.All exterior lighting shall be so directed so as not to cast glare toward or onto the <br /> public right-of-way or neighboring residential uses or districts; There should be no <br /> lighting or glare resulting from the grading project and <br /> 15. Not detrimental to the public health, public safety, or general welfare. The Applicant <br /> will be required to keep debris off of the public roadways. The noise resulting <br /> from the trucks hauling and equipment moving the material in and around the <br /> site should be minimized to the extent possible. The grading project will be <br /> monitored by the City Engineer and planning staff so as to minimize nuisances <br /> during the project. <br /> A CUP may be granted subject to such conditions as the Council may prescribe. Additionally, <br /> a CUP shall remain in effect as long as the conditions imposed by the City Council are <br /> observed, but nothing in this section shall prevent the city from enacting or amending official <br /> controls to change the status of conditional uses. <br /> Additionally Section 78-1286(e) provides guidance for the granting of a conditional use permit <br /> in the Shoreland Zone. Specifically, 78-1286(e)states the following: <br /> 1. Grading or filling in any type 1, 2, 3, 4, 5, 6, 7 or 8 wetland must be evaluated to <br /> determine how extensively the proposed activity would affect the following functional <br /> qualities of the wetland: The grading impacting the small interior wetland appears <br /> to be supported by WCA, whose review is ongoing. The wetland maybe <br /> impacted by the creation of the two beaches. <br /> 2. Alterations must be designed and conducted in a manner that ensures only the <br /> smallest amount of bare ground is exposed for the shortest time possible. The <br /> applicant will be required to adhere to the City's erosion control regulations as <br /> well as the permitting requirements of the MCWD. <br /> 3. Mulches or similar materials must be used, where necessary, for temporary bare soil <br /> coverage, and a permanent vegetation cover must be established as soon as <br /> possible. The applicant will be required to adhere to the City's erosion control <br /> regulations as well as the permitting requirements of the MCWD. Timely re- <br /> vegetation and stabilization will be a requirement of the permitting process. <br /> 4. Methods to minimize soil erosion and to trap sediments before they reach any surface <br /> water feature must be used. The applicant will be required to adhere to the City's <br /> erosion control regulations as well as the permitting requirements of the <br /> MCWD. Timely re-vegetation and stabilization will be a requirement of the <br /> permitting process. <br /> 7 <br />
