���p CITY OF ORONO <br /> RESOLUTION OF THE CITY COUNCIL <br /> � �` rro. <br /> 682 � <br /> y� <br /> � <br /> ��xFSHO�� <br /> WHEREAS, on November 20, 2017, the Planning Commission recommended <br /> approval of the variances, conditional use permits and easement vacations; and <br /> WHEREAS, on December 11, 2017,the City Council reviewed the application and <br /> the recommendations of the Planning Commission and City staff; and <br /> NOW,THEREFORE, BE IT RESOLVED that the City Council of Orono, Minnesota <br /> hereby approves the requested variances, conditional use permits and easement vacations as <br /> described above based on one or more of the following findings of fact concerning the Property: <br /> FINDINGS OF FACT: <br /> 1. This application was reviewed as Zoning File #17-3988, #17-3989, #17-3990. The <br /> analysis contained within staff memos and the exhibits attached to the aforesaid memos, <br /> all minutes from the above mentioned meetings,and any and all other materials distributed <br /> at these meetings are hereby incorporated by reference. <br /> 2. The Property is located in the LR-1 C Zoning District. <br /> 3. The Property contains 2.16 acres in area and had a defined width of over 200 feet. <br /> 4. In September, 2017, the City Council granted preliminary plat approval for Ivy Place, <br /> Zoning File#17-3962. <br /> 5. The Property is within Tier 1 and hardcover is limited to 25% according to the Stormwater <br /> Quality Overlay District. <br /> 6. Applicant has applied for the following variances: <br /> a. Wetland setback <br /> b. Driveway to exceed 8 feet in width <br /> 7. Applicant has applied for the following condition use permits: <br /> a. Filling in the floodplain <br /> b. Moving over 50 cubic yard within the 75 foot lakeyard setback <br /> c. Land alteration for grading activities exceeding 500 cubic yards in the shoreland <br /> overlay district <br /> 8. Wetland alterations <br /> a. Filling in a small 168 sq ft wetland in proposed lot 2, and <br /> b. in two areas to create a beach area. <br /> 2 <br />
