As stated <br /> over the telephone, fence heights in front yards cannot exceed 42 inches. However, after further research on the <br /> above noted property it may be possible to erect a fence 6' in height along North Shore Drive if either point— 1 or <br /> 2 below is true and applicable to the property: <br /> 1) The piece of property, PID#08-117-23-34-0040, north of Cherry Avenue from 3818 North Shore <br /> Drive is in legal combination with the property addressed 3818 North Shore Drive (PID#08-117- <br /> 23-34-0060) and a 929.4' elevation can be located on that parcel on either parcel. The 929,4' <br /> elevation is key as that elevation is considered the OHWL (ordinary high water level) of Lake <br /> Minnetonka. <br /> 2) The parcel addressed. 3818 North Shore Drive contains a 929.4' elevation, regardless of <br /> combination status of the parcel located north of Cherry Avenue. <br /> Items 1 and 2 above, if true, classify 3818 North Shore Drive as a lakeshore lot on a major thoroughfare,which is <br /> permitted fences 6' in height along street yards, in accordance with Zoning Ordinance Section 78-1405 (7) (see <br /> attached for your reference). As a point of reference with regard to the Zoning Ordinance Section attached, a <br /> lakeshore lot's front yard is the same as the lake yard and the rear yard is the street yard. <br /> 3) If the two parcels are not legally combined or if the main parcel at 3818 North Shore Drive does <br /> not contain a 929.4' elevation of Lake Minnetonka, and therefore the lot is not a lakeshore lot on <br /> a major thoroughfare, an alternative would be to request a Special Lot Combination Agreement, <br /> whereby the two parcels (08-117-23-34-0040 and 08-117-23-34-0060) are legally required to <br /> remain in combination.
