� � �TEM <br /> 1C <br /> Ww- % /�S , z'Y;C",�:. <br /> r � <br /> i � <x <br /> t ��E" �� <br /> LAKI; MINN�TONKA CONSEItVAT10N DISTRICT <br /> IZE: APPLICATION OF NANCY BLAIR <br /> FINDINGS <br /> A public hearing was held at 7:00 o'clock p.in. on Wednesday, Pebruary 8, 2006, at the Wayzata <br /> City Hall in the City of Wayzata, Minnesota, on the application of Nancy Blair ("Applicant") for a <br /> bridge permit and variances for a bridge located at 3768 North Shore Drive on North Arm in the <br /> City of Orono ("Subject Property"). <br /> The hardship stated by the Applicant is that the dock use area is covered by emergent vegetation and <br /> water that is too shallow for navigation of watercraft. <br /> The Applicant proposes to construct a bridge that would extend approximately 322 feet from the <br /> shoreline to reach the shore lane of a peiunsula, which is also ov�nled by the Applicant. The <br /> Applicant will also install a dock on the open water side of the peninsula for watercraft storage. <br /> Because the proposed bridge does not meet the requirements of LMCD Code, Section 2.13, Subd. <br /> 4(e), a variance is required. <br /> The bridge will be constructed over an area covered by emergent vegetation and water that is too <br /> shallow for navigation of watercraft. Therefare,the structure will not impede navigation. <br /> The Board finds that the shallow water azid emergent vegetation within the dock use area for the <br /> Subject Properiy constitute a hardship within the meaning of LMCD Code, Section 1.07, and that <br /> granting the variance is consistent with the spirit and intent of the Code, provided the facility is <br /> constructed and operated in accordance with the conditions hereinafter set forth. <br /> ORDER <br /> ON THE BASIS OF THE FOREGOING, IT IS ORDERED that the Board of Directors of the Lake <br /> Minnetonlca Conservation District grants the application of Nancy Blair for a bridge permit and <br /> variances, subject to fl�e following limitations: <br /> l. The bridge structure shall be constructed in strict conformance with the plans attached <br /> hereto as Attachment One. <br /> 2. No other dock structures may be constructed at the subject premises except in compliance <br /> with the LMCD Code, and within the authorized dock use area for the Subject Property. <br /> 3.
