Staff believes an adjustment of that lot line for a bridge <br /> or a dock is justified. <br /> Staff believes that the difficulty of conforming to the ordinance is due to circumstances unique to the <br /> property. This is a property that has approximately 225' of 929.4'shoreline but some of it has emergent <br /> vegetation in front of it and in-between the primary property and the end of a peninsula that the applicant <br /> owns. The peninsula has approximately 200' of 929.4'shoreline on the lake ward side of the peninsula. <br /> The property is adjacent to an inlet that that has some water depth issues and is located next to a busy <br /> public access. Staff does not believe that the problem is created by the applicant. <br /> In compliance with MN DNR General Permit 97-6098,the MN DNR and the City of Orono were providetl a copy <br /> of the proposed variance application on 1/24/06, with comments due in the LMCD office by 2/6/06. Staff also <br /> provided Hennepin County Environmental Services and the Minnehaha Creek Watershed District(MCWD) <br /> copies of the proposed bridge permit and variance applications. Hennepin County Environmental Services <br /> operates the public access adjacent to this site. Minnehaha Creek Watershetl District permits water crossings. <br /> Mr. Tony Brough, Hennepin County Environmental Services provided the attached comments. To date, staff has <br /> not received feedback from the City of Orono, MN DNR or MCWD on the proposed bridge permit and variance <br /> applications. <br /> RECOMMENDATION <br /> Staff believes that there are a number of fundamental questions that the Board should discuss prior to taking <br /> action on these applications. <br /> • Is the proposed use reasonable? <br /> • Is 3 to 3 %2 (at 929.4' NGVD) adequate water depth for navigation? <br /> • Would it be preferable to grant a dock length antl adjustment of a dock use area variances? <br /> � Would the proposed bridge plan be beneficial to keep a dock away from the public access? <br /> • Would the variance for the bridge adversely affect the purposes of this ordinance and reasonable access to <br /> or use of the Lake by the public or riparian owners? <br />
