t <br /> LAKE MINNETONKA CONSERVATION DISTRICT <br /> February 3, 2006 <br /> T0: Board of Directors <br /> /`�� <br /> FROM: Judd Harper,Administrative Technician �,.�� <br /> / <br /> SUBJECT: Bridge and Variance Applications <br /> BACKGROUND <br /> Nancy and Marvin Blair, 3768 North Shore Drive have submitted bridge permit and variance applications for Board <br /> consideration on North Arm in the City of Orono. The variance application has been submitted for variance from <br /> Lake Minnetonka Conservation District (LMCD) Code for bridge length requirements and an adjusted bridge use area <br /> with particular hardships of shallow water and a converging lot line. Pursuant to LMCD Code, the attached public <br /> hearing notice was published in the 1/24/06 edition of the Lakeshore Weekly News, <br /> The applications were submittetl for a bridge that would extend approximately 322' from the 929.4' NGVD shoreline <br /> where the home is located to reach the 929.4' shoreline of a peninsula owned by the applicant. The applicant <br /> proposes to then install a dock on the lake ward side of the peninsula to store watercraft, The proposed bridge will be <br /> constructed of traditional seasonal dock material. <br /> DISCUSSION <br /> To evaluate the proposed applications, staff believes that four Code Sections apply to them. They include: <br /> 1. Code Section 2.13, subd. 3 states that No person may locate, construct, install or maintain a bridge on the Lake <br /> without first securing a permit therefor from the Executive Director pursuant to this section. The Code allows the <br /> Executive Director to grant the permit if the information providetl shows that the bridge will be in compliance with <br /> the Code. <br /> Staff would normally process the bridge application without board review but the proposed bridge does <br /> not conform to the standards in Code Section 2.13 Subd. 4e,thus a variance application with public <br /> hearing is required. Further discussion of the proposed bridge is detailed below. <br /> 2. Code Section 2,13, subd.4e states that bridges shall conform to the following standards: <br /> 1) The length of the bridge may not exceed 100 feet without a variance. <br /> 2) The bridge must be constructed between the extentled lot lines of the sites at both ends of the bridge <br /> unless a variance is granted. <br /> 3) The bridge may not be constructed in a dock use area of another property without a variance. <br /> 4) The bridge may not unreasonably interfere with navigation or access to other riparian property. <br /> 5) No watercraft may be stored or tied up at the britlge. <br /> 6) The britlge shall be no wider than necessary to serve its intendetl function <br /> As noted above, a variance application with public hearing is required because the bridge is proposed to <br /> be longer than 100' and is not located between the extended lot lines of the sites at both ends of the <br /> bridge. <br />
