,' . <br /> z <br /> i� <br /> r O I <br /> �O O <br /> ��e � CITY of OROl�O <br /> � ' �� �' , , z•. <br /> ti .. <br /> \�',� �'� RESOLUTION OF THE CITY COUNCIL <br /> ��kESH��� NO. � � r r� <br /> A RESOLUTION DENYING <br /> AFTER-THE-FACT VARIANCES PER <br /> MUNICIPAL ZONING CODE <br /> SECTIONS 10.22, SUBDIVISION 1 (B) AND 2; <br /> 10.56, SUBDIVISION 16 (L) (1); <br /> AND SECTION 10.03, SUBDIVISION 14 (C). <br /> FILE#2443 <br /> WHEREAS,the City of Orono is a municipal corporation organized and existing <br /> under the laws of the State of Minnesota; and <br /> WHEREAS,pursuant to State Statutes 412 et. seq. and 462 et. seq.,the City Council <br /> of the City of Orono has adopted zoning regulations for the protection of the public health, safety <br /> and general welfare; and <br /> WHEREAS, Glenn C. Upton (hereinafter "the applicant") is the owner of the <br /> property located at 3685 North Shore Drive within the City of Orono (hereinafter "the City") and <br /> legally described as follows: <br /> Exhibit A attached (hereinafter "the property"); and <br /> WHEREAS, the applicant has applied to the City of Orono for after-the-fact <br /> variances to permit a lakeside deck located 40' from the 929.4' Ordinary High Water Level (OHWL) <br /> of Lake Minnetonka, a General Development Lake, requesting the following approvals: <br /> 1. Section 10.22, Subd 1 (B): To permit the construction of a residential deck 40' from <br /> the lakeshore where 75' is required. <br /> 2. Section 10.22, Subd. 2 and Section 10.56, Subd. (16)(L)(1): To allow 1,897.6 s.f. <br /> (22.6%) hardcover where 0% is normally allowed. <br /> 3. Section 10.03, Subd. 14 (C): To allow structural coverage to increase from 1,888.75 <br /> s.f.
