D+ RESOLUTION OF THE CITY COUNCIL <br /> �� G'�'� NO. � � � �I <br /> �`�kESHo�'� <br /> NOW, THEREFORE BE IT RESOLVED by the City Council of Orono, <br /> Minnesota: <br /> FINDINGS <br /> 1. This application was reviewed as Zoning File number 14-3660. <br /> 2. The Property is located in the LR-1 C One Family Lakeshore Residential Zoning <br /> District which requires a minimum lot area of 0.5 acre and a minimum lot width of <br /> 100'. <br /> 3. The Planning Commission reviewed this application at a public hearing held on <br /> April 21, 2014 and voted 6 for and 0 against on a motion to approve the <br /> conditional use permit and variances based on the following findings: <br /> a. The Property contains 16,612 square feet in area and has a defined width of <br /> 198' at the OHWL and 100' at the 75-foot setback. <br /> b. The orientation of the Property with respect to County Road 51, the private <br /> access road, and the lakeshore results in a practical difFiculty preventing <br /> placement of a reasonable sized home on the Property in a conforming <br /> location. <br /> c. There were no negative neighbor comments received regarding the <br /> Applicants' proposed plan. <br /> d. The proposed home location will not adversely impact views of the lake <br /> currently enjoyed by the adjacent properties. <br /> e. The Property will conform to the hardcover limitations of Tier 1 and structural <br /> coverage limitations. <br /> f. The design and orientation of the proposed home should reduce massing <br /> with the 75-foot setback area, particularly along the channel. The proposed <br /> home will not alter the essential character of the neighborhood and will result <br /> in minimal or no negative impact on adjacent properties. <br /> g. The proposed grading within the 75-foot setback area is necessary for the <br /> construction of the new home and will have no impact on surrounding lands. <br /> Drainage patterns for runoff leaving the Property will not be significantly <br /> altered. The resulting grades will be similar to the other properties in the <br /> neighborhood. <br /> Page2of5 <br />
