The 5' side setback has been requested to provide one additional pazking <br /> space on the property. The Zoning Code requires residential properties to <br /> have 2 off-street pazking spaces. To accommodate a second parking space <br /> next to the house, a side setback variance is required because the house is <br /> shifted towards the west side property line. The pazking stall must be located <br /> between the house and side property line due to the shared driveway located <br /> behind the house. The driveway is narrow and permanent pazking within the <br /> driveway azea would block through traffic. <br /> G. No parking is available on the opposite side of the shazed driveway as the <br /> land immediately begins to rise to the elevation of North Shore Drive. <br /> H. A typical parking space in a commercial area is 9' X 20' in size. The <br /> proposed parking area would be approximately 10'X 20'. � <br /> 5. The City Council finds that the conditions existing on this property are peculiar to it <br /> and do not apply generally to other property in this zoning district;that granting the <br /> variances will not adversely affect traffic conditions,light,air,nor pose a fire hazazd <br /> or other danger to neighboring property;would not merely serve as a convenience to <br /> the applicants,but is necessary to alleviate a demonstrable hardship or difficulty; is <br /> necessary to preserve a substantial property right of the applicants; and would be in <br /> keeping with the spirit and intent of the Zoning Code and Comprehensive Plan of the <br /> City. <br /> 6. The City Council has considered this application including the findings and <br /> recommendations of the Planning Commission,reports by City Staff, comments by <br /> the applicants and the effect of the proposed variance on the health, safety and <br /> welfare of the community. <br /> CONCLUSIONS, ORDER,AND CONDITIONS <br /> Based upon one or more of the above findings, the Orono City Council hereby grants <br /> variances to Municipal Zoning Code Section 10.22, Subdivisions 1 and 2, Section 10.55, <br /> Subdivision 8 and Section 10.56, Subdivisions 16(L) 1 and 2 to permit 615 s.f. (16.4%)hazdcover <br /> in the 0-7�'lakeshore setback where 660 s.f.(17.6%)hardcover exists and no hazdcover is allowed, <br /> and to permit 884 s.f. (51.6%)hazdcover in the 75-250' setback where 932 s.f. (54.4%)hardcover <br /> eYists and 428 s.f. (25%) hardcover is allowed; Section 10.25, Subdivision 6 (B) to permit new <br /> construction on the lot with a defined lot area of 5,462 s.f. where 21,780 s.f. is required and a lot <br /> width of�0'where 100'is required,and to permit a side yard setback of 5'for the house where a 10' <br /> Page 3 of 7 <br />
