Drainage easements are dedicated on the final plat and conservation and flowage <br />easements are granted for all City of Orono protected wetlands as identified on the <br />Wetland Inventory Maps. <br />5. Covenants will be filed in the chain of title for each lot as an advisory to fittnre <br />property owners that primary and secondary drainfield sites exist on the property and <br />are protected. <br />b. A driveway maintenance agreement has been.created to identify such maintenance <br />of Outlot A. Lots 1 and 2 shall both access Outlot A. <br />7. The westerly 33' lying within the Stubbs Bay Road North right-of-way is dedicated <br />on the plat to the public as public right-of-way. <br />8. Payment to the City for the final plat review fee and fee for legal review and filing <br />of the plat, easements and covenants in the amount of $400.40. <br />9. Payment to the City for park dedication fees for the creation of one (1) new lot in the <br />amount of $4,900. <br />NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Orono <br />hereby approves the plat of Tamarack Hill, Hennepin County, Minnesota, subject to the following <br />conditions: <br />1. Prior to City release of the plat for filing, applicant shall provide evidence of fee <br />ownership of the property in a form acceptable to the City Attorney, and applicant <br />shall meet any other title requirements and requirements of Preliminary Plat approval <br />as may be required by the City Attorney. <br />2. Applicant shall provide all documents noted in this resolution in a format acceptable <br />to the City Attorney prior to release of the plat for filing, and shall complete all <br />conditions to the satisfaction of City staff; prior to release of the plat for filing. <br />3. The aforesaid plat shall be filed by the City of Orono with either the Hennepin <br />County Recorder's Office or Registrar of Titles Office on or before February 14, 2001 <br />together with a certified original copy of this resolution and executed copies of the <br />easements and covenants noted above. <br />Page 2 of 4 <br />
