October 9, 2016 <br />Thomas & Susan Fleming <br />300 Stubbs Bay Road <br />Orono, MN 55356 <br />Subject: Item #15-3763116-3860 Christopher & Gail BollisiChristopher & Rachel Bollis <br />200-350 Stubbs Bay Road North <br />Dear City Council Members, <br />We would like to provide feedback on the Final Plat Approval-Resoution for Kyntyre <br />Preserve, specifically related to the Future Access Use of Outlot A, Tamarack Hill <br />referenced in item #9 of the CA memo dated October 7, 2016. As part owner of Outlot A, <br />Tamarack Hill, we feel the back driveway should not become permanent and should be <br />abandoned once the public road through Kyntyre Preserve is established. <br />We fully agree with the staff's recommendation to the City Council based on the four - <br />point scenario presented on page 4. <br />Our support for this scenario is detailed below: <br />1. The sole existence of Outlot A is to provide driveway access to a single home in <br />Tamarack Hill, Lot 2. Tamarack Hill, Lot 2 will be eliminated with the <br />development of Kyntyre Preserve. A new public road will serve lots 5 and 6 with <br />driveway access from this road. The absorption of Tamarack Hill, Lot 2 into <br />Kyntyre Preserve eliminates the original intent for the establishment of Outlot A. <br />2. The applicant has expressed concern that the only viable access to the storage <br />barn on Lot 5 is via the gravel driveway on Outlot A. The barn in question is not <br />connected to the gravel driveway that runs through Outlot A, Tamarack Hill. The <br />gravel driveway ends at the home garage entrance. A new driveway access to <br />the shed would have to be established regardless during development of Lot 5. <br />3. No effort was made by the applicant to meet with us and discuss "secondary" <br />access to Kyntrye Preserve or to define what "secondary access" means in terms <br />of construction, access easements or long term maintenance. This dialog was <br />discussed during the City Council meeting on September 12th, 2016 and verbally <br />affirmed outside chambers after the meeting. It appears from the applicant <br />proposal that the plan for Outlot A, Tamarack Hill has not changed since the City <br />Council meeting on 9112116. <br />4. The request by the applicant to establish secondary access for Lots 5 and 6 is <br />not allowed according to Code Section 18-136(a), Residential driveways, <br />approaches and turnaround which states "one driveway approach shall be <br />allowed from up to two single residential parcels of land to the same road, <br />provided that appropriate easements exist between parties sharing the driveway <br />and driveway approach.
