REQUEST FOR COUNCIL ACTION <br />DATE: November 14, 2016 <br />ITEM NO: 6 <br />Department Approval: Administrator Reviewed: Agenda Section: <br />Name Jeremy Barnhart Y"-4 <br />Title Community Development Director <br />Planning <br />Item Description: Consideration of location restrictions, Level III Sex Offenders <br />Application Summary <br />Information presented to facilitate the public hearing, and for Council direction. <br />Issue <br />Level III Sex Offenders are individuals that have committed sex related crimes, been adjudicated, <br />imprisoned, and have been designated as 'likely to reoffend' upon their release. When a Level III <br />individual is released, the State holds a neighborhood informational meeting. Currently, there is no city <br />ordinance that provides guidance as to where Level III offenders may reside. <br />Minnesota communities are starting to respond to these concerns by drafting ordinances that prohibit <br />residence of Level III offenders within certain distances of parks, schools, day care centers. Previous <br />direction of the Council was to explore possible ordinances, after receiving comment from the public. <br />It should be noted that no ordinance is proposed that regulates where Level I and Level II offenders may <br />reside, as the designation of a Level I or II individual is not public information, and therefore, not known <br />to the city or the public, and this knowledge is necessary to administer an ordinance. <br />The Police Chief has provided a memo that provides additional background and resources, originally <br />offered September 26, 2016. <br />The Council should receive input from citizens as to what concerns should be addressed in a potential <br />ordinance. <br />Action Requested: <br />Provide Staff direction. <br />List of Exhibits: <br />Exhibit A.
