CITY of ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO, 4'06 <br />A RESOLUTION VACATING A PORTION OF <br />AN UNIMPROVED STREET WITHIN THE <br />PLAT OF 13AYSIDE ADDITIION TO LADE MINNETONKA, <br />HENNEPIN COUNTY, MINNESOTA <br />FILE NO. 01-2707 <br />WHEREAS, the City of Orono is a municipal corporation organized and existing <br />under the laws of the State of Minnesota; and <br />WHEREAS, on September 22, 2001 Robert A. Eddington and Mark R. Larson <br />(hereinafter "the applicants") filed a petition with the City of Orono requesting the vacation of <br />a portion of an unimproved public right-of-way originally dedicated in the plat of Bayside <br />Addition to Lake Minnetonka, Hennepin County, Minnesota lying between Lot 8 Block 2 and <br />Lot 1 Block 5 thereof, and legally described as follows: <br />That part of Hill Street which lies between the northerly extensions of the east <br />and ,vest lines of Lot 1, Block 5, `Bayside Addition to Lake Minnetonka", <br />Hennepin County, Minnesota; and <br />WHEREAS, after due published and posted notice, a public hearing was held <br />by the City's Planning Commission on October 15, 2001 regarding said vacation and all <br />interested persons were given an opportunity to be heard; and <br />WHEREAS, after due standing and consideration, the Planning Commission <br />recommended unanimous approval of the proposed vacation; and <br />WHEREAS, the City Council of the City of Orono finds that said vacation as <br />proposed is in keeping with the public interest and in consideration of the following findings; <br />1. The unimproved right-of-way contains no municipal sewer or other utilities. <br />2. The 40 foot right-of-way has never been developed as a public street. <br />3.
