colors approved by the Review Committee may not be changed without the same <br />approval, <br />b. Individual Sewage Treatment Systems. Individual sewage treatment systems <br />shall be built into the existing contour of the Lot, and landscaped to mask the <br />appearance of a "mound." Any access portals or pipes used to pump out <br />underground holding tanks shall be installed not more than two inches above <br />ground level, and shall be capped in a manner consistent with best industry <br />practices. <br />C. Landscape Plans. Generally, landscape plans shall contemplate turf shrubs, trees <br />and flower gardens, to be maintained by the Owner of the Lot. Landscape plans <br />providing for non -maintained areas may be permitted only in areas of heavy tree <br />cover. Landscape plans which include plantings of native grasses, wildflowers <br />and/or other plantings intended to create a low maintenance landscape of natural <br />appearance, may be permitted only when the same will be professionally <br />designed, installed and maintained to maturity and where the same are appropriate <br />to neighboring landscape. <br />SECTION 9 <br />COMMON EXPENSES <br />9.1 Common Area. The costs of maintaining, repairing and replacing the Common Area, <br />and the Roadwany other improvements on the Common Area, and <br />the costs incurred by the Association in otherwise performing its obligations under this <br />Declaration, shall be Common Expenses. <br />9.2 Other Common Expenses. The following shall also be Common Expenses: <br />a. The costs of maintaining, repairing and replacing, and paying the cost of <br />electricity used by, any and all street lights, if any, within the Property that are not <br />otherwise owned by an Owner, including all street lights located on the Common <br />Area, to the extent not maintained by the City or the County; <br />b. Any real estate taxes and special assessments levied against the Common Area; <br />C. The costs of maintaining the Retention Pond and all other storm water ponds and <br />other storm water management facilities now or hereafter constructed on the <br />Property; and <br />d. The costs of maintaining and complying with the ecological restoration and <br />management program for the Property prosed by Declarant and approved by the <br />City, as the same hereafter may be amended from time to time within the City's <br />approval. <br />SECTION 10 <br />it <br />188927v1 <br />
