. w <br /> � <br /> �� 0� <br /> O O <br /> , CITY of ORONO <br /> � � <br /> ,� G'�� RESOLUTION OF THE CITY COUNCIL <br /> �9kES804�' NO. _ 4 :3 c`� � <br /> CONCLUSIONS, ORDER AND CO�IDITIONS <br /> Based upon one or more of the above findings, the Orono City Council hereby <br /> grants variances to Municipal Zoning Code Section 10.22, Subdivision 2 and Section 10.56, <br /> Subdivision 16 (L) (2) to allow 2.�15.9 s.f. (38.9%) of hardcover in the 75-250' setback area <br /> where 1,662.4 s.f. (2�.7%) exists and 1,613.63 s.f. (25%) is allowed for construction of a two <br /> stall attached garage. Approval «•as subject to the following conditions: <br /> 1. The applicants shall removed the storage shed on the property within 90 days <br /> of receiving the building pernut or prior to final inspection, whichever is eazlier. <br /> 2. Council approval is based on the site plan submitted by the applicants attached <br /> to this resolution as Exhibit A. Any amendments to the site plan may require <br /> further Planning Commission and City Council review. <br /> ;. Authorities granted by this variance run with the property not with the <br /> applicants, but are permissive only and must be exercised by application for a <br /> building permit wzthin one year of the date of Council approval, or this variance <br /> will expire on that date (November 22, 2000). <br /> 4. Violation of or non-compliance with any of the terms and conditions of this <br /> resolution shall constitute a violation of the zoning code, shall automatically <br /> terminate any authority granted herein, and shall be punishable as a <br /> misdemeanor. <br /> 5. The undersigned applicants have read, understood and hereby agree to the terms <br /> of this resolution and on behalf of themselves, their heirs, successors and <br /> assigns, hereby agree to the recording of this resolution in the chain of title of <br /> the property. <br /> Page 3 of 6 <br />
