In the event Mr. Dunn cannot obtain a building permit for a private residence on <br /> this particular site, cannot use the site for commercial purposes, and cannot <br /> construct a private dock on the site what, if any, use of this property is permitted <br /> by the City of Orono's zoning classification? <br /> 4. Are there other instances in which the City of Orono has either authorized or <br /> acquiesced to the construction of a private or commercial dock facility in LR-1C <br /> zoning classifications or any other zoning classification which requires users to <br /> cross public thoroughfares to gain access to the dock? If so, please specify the <br /> location of such facilities. <br /> I understand much of the information sought above might be perceived by you as arcane. <br /> However, it is my understanding this particular parcel of property is not sufficiently large to <br /> permit construction of any structure and if Mr. Dunn is unable to construct a private dock on <br /> the site, whatever value this parcel may have has been effectively taken by the City of Orono. <br /> Further, I also have information that, to avoid such an unfair result, the City of Orono has <br /> routinely permitted other property owners to construct private or commercial docks in areas <br /> which require the crossing of a public thoroughfare to gain access to the dock. In that event, <br /> I am understandably curious why the City seems to be treating Mr. Dunn differently than other <br /> property owners. Confirming the accuracy of this information, or correcting any <br /> misunderstanding on my part, will be quite helpful as I advise Mr. Dunn of the legal options <br /> available to him and his prospects for success in connection with any possible legal proceeding <br /> involving your June 5, 1996 letter. <br /> If you have any questions, please feel free to give me a call. <br /> Very o� , <br /> Glenn P.
