Allowed hardcover in the 250 to 500 foot zone can be reduced by <br /> the amount of extra hardcover in the 75 to 250 foot zone so the total <br /> amount of hardcover on the property would be no more than the <br /> total permitted on the entire lot without the variance. <br /> 4. The City Council has considered this application including the findings and <br /> recommendation of the Planning Commission, reports by City staff, comments <br /> by the applicants and the public, and the effect of the proposed variance on the <br /> health, safety and welfare of the community. <br /> 5. The City Council finds that the conditions existing on this property are peculiar <br /> to it and do not apply generally to other property in this zoning district; that <br /> granting the variances would not adversely affect traffic conditions, light, air <br /> nor pose a fire hazard or other danger to neighboring property; would not <br /> merely serve as a convenience to the Owner but is necessary to alleviate a <br /> demonstrable hardship or difficulty; is necessary to preserve a substantial <br /> property right of the Owner; and would be in keeping with the spirit and intent <br /> of the Zoning Code and Comprehensive Plan of the City. <br /> CONCLUSIONS, ORDER AND CONDITIONS <br /> Based upon the above findings, the Orono City Council hereby grants a variance to Orono <br /> Code Section 78-330 to allow modification of the roofline of a dormer that encroaches 1.9 <br /> feet into the 10 foot side setback and a variance to Orono Code Section 78-1288 to allow <br /> 26.48 percent hardcover in the 75 to 250 foot zone when 25 percent is allowed, subject to the <br /> following conditions: <br /> l. Council approval is based on the site and house plans submitted by the Owner <br /> and annotated by City staff, attached to this Resolution as Exhibits A and B. <br /> Any amendments to these plans may require further Ptanning Commission and <br /> City Council review. <br /> 2. Hardcover in the 0-75' zone shall be limited to 0 s.f. or 0%. Hardcover in the <br /> 75-250' zone shall be limited to 5,419 s.f. or 26.30%per the proposed site plan <br /> and hardcover allowance summary as depicted on Exhibit C. Hardcover in the <br /> 250-500' zone shall be limited to 1,271 s.f. or 24.75%. The owner is advised <br /> that any future requests to increase hardcover or change the nature of <br /> Page 3 of 5 <br />
