Also <br /> acknowledged is receipt of your check in the amount of $604.00. <br /> The City in its past licensing has agreed to allow you to have 76 <br /> rental slips, 6 transient slips, and 4 service slips for a total of 86 <br /> boats in the water, exclusive of dry stacked boats. <br /> The dry stack .agreement executed by the City of Orono and North Shore <br /> Drive biarina, Inc. on July 29, 1977, which is a stipulation of <br /> settlement of litigation between us, was a binding agreement that no <br /> more than 20 boats would be "dry stacked" for lake use. <br /> The 86 boat slips referred to and the 20 boats dry stacked have <br /> permitted you 106 boats for lake use. Additionally, 45 "other boats" <br /> on land for servicing, sale, etc. have been permitted for a total <br /> density of 151 boats. <br /> Your current license application, and we assume your current and <br /> intended use, shows a total boat density of 210. Two discrepancies <br /> are apparent. You propose 93 total boats in the water as opposed to <br /> 86. You propose 72 boats dry stacked for lake use, contrary to the <br /> Court settlement. <br /> Under its present ordinances, the City cannot license your marina for <br /> the number of spaces proposed.
