• 17. Uniqueness of the Premises. The City Council has � <br /> ' executed this agreement only because it finds that the premises <br /> are unique from other premises being used for marina purposes <br /> in that the premises include a large lot, topographical features <br /> ' which assist in screening the proposed storage units, and that <br /> � there are numerous large trees and other shrubbery on the <br /> premises which, along with the additional screeninq, will ; <br /> ; assist in screeninq the proposed storage units. These premises • <br /> � in that respect are different from the other marinas in the ; <br /> City of Orono along Lake Minnetonka. <br /> 18. Bond. In order to provide the City with the <br /> necessary security to reimburse the City for any expenses it . <br /> ; may incur in enforcing this agreement, Hork agrees, prior <br /> to the construction of the storage units, to file an irrevo- <br /> ' cable bond with the City in the amount of $5,000.00 in a <br /> . • � . ; <br /> form acceptable to the City. The bond shall be forfeit and � <br /> i <br /> � • <br /> any amount thereof shall be paid over to the City upon written • <br /> demand of the City to the bonding company specifying all costs � <br /> i of disassembly including legal fees incurred in compelling <br /> ,; ' 1 . disassembly of such units.
