� O� <br /> O 4 <br /> - CITY of ORONO <br /> � � <br /> ti <br /> ti <br /> RESOLUTION OF THE CITY COUNCIL <br /> ��`�kEsi30g'�G NO. ;1 � � ri <br /> A RESOLUTION <br /> GRANTING VARIANCES <br /> TO THE ORONO, MINNESOTA, CITY CODE <br /> SECTIONS 78-330 AND 78-1288 <br /> FILE NO. 09-3390 � <br /> WHEREAS, Glen Thomas Neddermeyer and Christine Marie <br /> Neddermeyer, husband and wife, (hereinafter "Owners") are the owners of the property <br /> located at 3186 North Shore Drive within the City of Orono (hereinafter "City") and legally <br /> described as: See attached Exhibit A. (hereinafter "the Property"); and <br /> WHEREAS, Michael Jones has made application to the City on behalf of the <br /> Owners for a variance to Orono Code Section 78-330 to allow construction of a replacement <br /> residence on a lot with a defined width of 28 feet when 140 feet is required; and <br /> � WHEREAS, Michael Jones has made application to the City on behalf of the <br /> . Owners for a variance to Orono Code Section 78-1288 to allow hardcover in the 250 to 500 <br /> foot zone in excess of the allowed 30 percent; and <br /> WHEREAS, Michael Jones has made application on behalf of the Owners to <br /> the City for a variance to Orono Code Section 78-1288 to allow hardcover in the 500 to 1,000 <br /> foot zone in excess of the allowed 35 percent; and <br /> WHEREAS, after due published notice and mailed notice in accordance with <br /> Minnesota Statutes and the Orono, Minnesota, City Code, the Orono Planning Commission <br /> held a public hearing on January 20, 2009, at which times all persons desiring to be heard <br /> concerning this application were given the opportunity to speak thereon. <br /> NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br /> Minnesota: <br /> FINDINGS <br /> l. This application was reviewed as Zoning File #09-3390. <br /> 2. The Property is located in the LR-1B zoning district, where 1 acre is the <br /> minimum lot area and 140 feet is the minimum lot width. The Property is <br /> Page 1 of 5 <br />
