As you aze awaze, the water depths in this part of Maxwell <br /> Bay can be quite shallow. The table below illustrates the water depths at various lengths <br /> froin our shoreline taken on 12/26/O2. On 12/2/02,the lake level was 928.61. <br /> Feet from Shore Water Depth @ Adjustment Factor Water Depth @ <br /> 928.61 as of 12/2/02 to 929.4 929.4 as of 12/26/02 <br /> 50' 17" 9.5" 26.5" <br /> 100' 25" 9.5" 34.5" <br /> 130' 29' 9.5" 38.5" <br /> 150' 38" 9.5" 47.5" <br /> As you are also aware,on 10/9/2002, the LMCD granted adjustmenfs to the dock use <br /> areas to the properties to our west, namely the Finney, Hendrickson/W'indenberg, <br /> Pacovsky and Blomberg properties, because of shallow water. During that process,the <br /> LMCD board adjusted the dock use area to the Blombergs, our immediate neighbor to the <br /> west, which included adjustments to their side setback requirements and a length <br /> extension to 130'. At the 10/9/2002 meeting, an adjustment to our dock use area.was <br /> proposed by Director Nybeck in order to accommodate the dock we share with the <br /> Blombergs. During the ensuing discussion,the boazd concluded that since water depths <br /> at our site were not documented and our immediate neighbors were not notified through a <br /> public hearing, the board could not grant us an adjustment to our dock use azea. <br /> However,board members Babcock, McMillian and Chairman Foster encouraged us to <br /> submit an application and that the boazd could consider waiving the fees for the Wallace <br /> variance application. <br /> In a letter dated 12/4/2002, Director Nybeck nodfied us that the above variances were <br /> granted and that"the Board encourages you to submit an application for variance form <br /> the LMCD Code and possibly a new multiple dock license, if you want to continue the <br /> shared dock with the Blomberg's or if you want to install you own dock out beyond�OQ.'.�.,�_,_„_.�._. ,a <br /> from the 929.4' shoreline".
